Herbs Packaging reserves the right to modify these Terms at any time. We will notify users of any material changes via email or website notice. Continued use of our services after such modifications constitutes acceptance of the updated Terms.

4. Order Process and Pricing
Order Placement
Orders may be placed through our website, email, or phone. All orders are subject to acceptance by Herbs Packaging. We reserve the right to refuse or cancel orders at our discretion, including but not limited to cases involving pricing errors, product unavailability, or compliance concerns.
Pricing and Payment
Prices are subject to change without notice. Custom orders require written quotations that are valid for 30 days unless otherwise specified. Payment terms are net 30 days for established accounts, with new customers required to pay in advance. Late payments may incur interest charges of 1.5% per month.
Minimum Orders
Minimum order quantities apply to most products. Custom products may have higher minimum orders. Volume discounts are available for large orders. Contact our sales team for specific minimum order requirements and pricing tiers.
5. Shipping and Delivery

6. Quality Assurance and Compliance
Quality Standards
Our products are manufactured under ISO 9001:2015 certification and Good Manufacturing Practices (GMP). We maintain strict quality control procedures and provide certificates of compliance upon request. All child-resistant packaging meets ASTM standards.
Regulatory Compliance
While we provide packaging designed for cannabis industry compliance, customers are solely responsible for ensuring their use meets all applicable regulations. We provide documentation to support compliance efforts but cannot guarantee regulatory approval in all jurisdictions.
7. Returns and Warranties
Return Policy
Returns must be authorized in advance and completed within 30 days of delivery. Custom products are non-returnable unless defective. Return shipping costs are customer's responsibility unless the return is due to our error.

Limited Warranty
We warrant products to be free from manufacturing defects for 12 months from delivery. This warranty does not cover normal wear, misuse, or damage from improper storage. Our liability is limited to replacement or refund of defective products.

8. Intellectual Property
Our IP: All designs, trademarks, and proprietary information remain property of Herbs Packaging. Customers receive limited license to use custom designs only for their intended packaging purposes.
Customer IP: Customers retain ownership of their trademarks and branded content. By providing designs or branding elements, customers grant us license to use them solely for manufacturing their packaging.
Confidentiality: We maintain strict confidentiality regarding customer designs, business information, and proprietary details. All employees sign confidentiality agreements.
9. Limitation of Liability
LIMITATION OF DAMAGES: In no event shall Herbs Packaging be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
MAXIMUM LIABILITY: Our total liability for any claim shall not exceed the amount paid by customer for the specific products or services giving rise to the claim, or $1,000, whichever is less.
REGULATORY COMPLIANCE: Customer assumes all responsibility for ensuring packaging compliance with applicable laws and regulations. We provide no warranties regarding regulatory approval or compliance.
10. Indemnification
Customer agrees to indemnify, defend, and hold harmless Herbs Packaging from any claims, damages, losses, or expenses (including attorney fees) arising from: (a) customer's use of our products; (b) customer's violation of applicable laws or regulations; (c) customer's breach of these Terms; (d) any third-party claims related to customer's products or business operations.
11. Governing Law and Disputes
Governing Law
These Terms are governed by the laws of China. Any disputes shall be resolved in the courts of Shenzhen, China. For international customers, we may agree to alternative dispute resolution methods.
Dispute Resolution
We encourage resolution of disputes through good faith negotiation. If formal proceedings are necessary, parties agree to attempt mediation before litigation. Legal proceedings must be commenced within one year of the dispute arising.
12. Termination
Either party may terminate the business relationship at any time with written notice. Termination does not affect existing orders or obligations. Upon termination:
- • Outstanding orders may be completed or cancelled by mutual agreement
- • All outstanding payments become immediately due
- • Confidentiality obligations survive termination
- • Customer must return any proprietary materials
